First Circuit Denies Disparate Treatment Claim & Upholds Termination of Uncertified Employee Print

In the attached case, the First Circuit Court of Appeals upheld the termination of a provisionally hired air marshal (TSA was the employer) in a Title VII race discrimination case because employee failed to successfully complete Federal Law Enforcement Training Center Program. In this case, the employee failed to show that he was treated differently than similarly situated employees regarding his disparate treatment allegations.
