"Sibling" Amendment to Maine's FMLA Print

On Thursday March 27, Governor Baldacci signed into law LD 2132 which amends Maine’s Family and Medical Leave Act. The amendment permits “sibling” with a “serious health condition” to be covered by the provisions of the Act, including up to 10 weeks of leave in 2 year period for a qualified employee. However, the Act limits "sibling" to the “sibling of an employee who is jointly responsible with the employee for each other’s common welfare as evidenced by joint living arrangements and joint financial arrangements”. Therefore, not all siblings would be covered under this amendment; only those with the joint arrangements as defined by the Act. Employers should update their family and medical leave policies accordingly.
